Citation: While walkiing though the cooler at 8:45 A.M. I noticed several packages of product on the retail side of the cooler that had no identification. Upon further investigation I was informed by Mr. that the product in question was cross-over product from the previous days production. During the stuffing of product, when lots are changed several packages of product are removed to prevent cross mixing of the products. These packages are kept for the establishments personal use. I informed Mr. that all product must be identified with some type of label regardless how it would be used later. This is a violation of 317.2(b) and 319.1(a). No further action was taken because the product was immediately identified for in-house use as cross-over product. No other violations of this nature in the last 60 days.
317.2(b) Any word, statement, or other information required by this part to appear on the label must be prominently placed thereon with such conspicuousness (as compared with other words, statements, designs, or devices, in the labeling) and in such terms as to render it likely to be read and understood by the ordinary individual under customary conditions of purchase and use. In order to meet this requirement, such information must appear on the principal display panel except as otherwise permitted in this part. Except as provided in § 317.7, all words, statements, and other information required by or under authority of the Act to appear on the label or labeling shall appear appear thereon in the English language: Provided, however, That in the case of products distributed solely in Puerto Rico, Spanish may be substituted for English for all printed matter except the USDA inspection legend.
319.1(a) Labels for products for which standards of identity or composition are prescribed in this part shall show the appropriate product name, an ingredient statement, and other label information in accordance with the special provisions, if any, in this part, and otherwise in accordance with the general labeling provisions in part 317 of this subchapter, and such products shall be prepared in accordance with the special provisions, if any, in this part and otherwise in accordance with the general provisions in this subchapter. Any product for which there is a common or usual name must consist of ingredients and be prepared by the use of procedures common or usual to such products insofar as specific ingredients or procedures are not prescribed or prohibited by the provisions of this subchapter.
