Citation: Today while I was performing a labeling review I noticed that the labels being applied to this days production of the following items had printed on them "Product of USA' when in fact the product consisted of product from animals from the USA and Canada. The affected boxes contained: beef kidneys, oxtails, liver, cheek meat, lips, tongues and hearts (all beef products). I applied 4 "U.S. Retained" tags (# 737264 - 737267) to the 4 carts that held the days production. These carts held 65 boxes of product. When the company was notified, they relabeled the product by applying labels that stated correctly "Product of USA and Canada". I should note that in the discussion with I informed him that the COOL (country of origin labeling) only requires that retail sales list the country of origin for these products. If no country is listed on the labels and all sales are for further processing (wholesale) then no country of origin is required on the labels. This misleading labeling is a violation of 317.8 which states in part that "No product....shall bear any false or misleading....impression or give any false indication of origin...."
317.8(a) No product or any of its wrappers, packaging, or other containers shall bear any false or misleading marking, label, or other labeling and no statement, word, picture, design, or device which conveys any false impression or gives any false indication of origin or quality or is otherwise false or misleading shall appear in any marking or other labeling. No product shall be wholly or partly enclosed in any wrapper, packaging, or other container that is so made, formed, or filled as to be misleading.
