Citation: On April 19, 2012 FSIS form 8140-1 (Notice of Receipt of Adulterated or Misbranded product) was received from establishment 5223. The following noncompliance was found: On 3/16/12 Manchester Packing (Est. 5223) located in 349 Wetherell street, Manchester, CT 06040 received a total of 128 boxes of bone dust. Half of the boxes of bone dust were labeled as inedible but not denatured in accordance with regulations. In addition, the boxes marked as inedible contained bone dust inside plastic bags bearing the mark of inspection. Nicholas Meat LLC is in violation of 9 CFR 316.6, 316.7 and 317.8 .
316.6 No person shall remove or cause to be removed from an official establishment any products which the regulations in this subchapter require to be marked in any way unless they are clearly and legibly marked in compliance with such regulations.
316.7 No brand or other marking device shall be false or misleading. The letters and figures thereon shall be of such style and type as will make a clear and legible impression. All markings to be applied to products in an official establishment shall be approved prior to use by the Administrator as provided for in § 317.3 of this subchapter, except that official markings prescribed by the Federal meat grading regulations (7 CFR 53.19) need not be submitted to the Administrator for approval.
317.8(b) Products which have been inspected and passed but do not bear the official inspection legend may be removed from an official establishment in closed containers bearing the official inspection legend and all other information required by this part and part 317 of this subchapter: Provided, That upon removal from such closed container the product may not be further transported in commerce unless such removal is made under the supervision of a Program employee and such product is reinspected by a Program employee and packed under his supervision in containers bearing the official inspection legend and all other information required by this part and part 317 of this subchapter: And provided further, That unmarked product shall not be brought into an official establishment in an open container.
