Violation: 416.13(c), 416.4(d)

Citation: At approximately 1815 hours on Monday, September 20, 2010, while performing ISP code 01C02 in room 2335, (ham boning) I observed the following noncompliance. I observed a Production Employee, who was working on the Ham boning line, (the line closest to the cooler) adjusting the stand on which he stood on to work on the line. After the Employee was done adjusting his stand, I observed the employee get back up on the stand and begin to start cutting up meat, without changing his Gloves or washing his hands. I didn't see any Plant Management in the room so I took Regulatory control by stopping the line. Once Plant Management came into the room, I retained the Vat which contained the Meat that was cross contaminated. I retained the Vat of Pork trimmings which weighted approximately 552 pounds, with USDA retain Tag # B18 774191. I informed both Mr. Production Supervisor and Technical Services. The Establishment was notified of their failure to meet the requirements of 416.13(c) and 416.4(d) of the Meat and Poultry regulations as well as the requirements of section 3.2: All other Food Processing Operations, under operational Sanitation section of the Est. written SSOP program dated and last revised 09/03/2010. No documentation was noted on the SSOP operational Monitoring form prior to my observations. This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action as outlined in 9 CFR 500.4.


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
