Citation: At 0614 hours, while inspecting the condition of the coolers, I found the following noncompliances: 1. There were two small silver dump tanks full of product, which was not labeled. The product looked like product that came from the ground chicken/turkey area. I tagged the product with USDA tag #B37853324. 2 Directly as you enter cooler # 7 (on the left side ), there was approximately 5 boxes of product, which was not labeled. I tagged the product with USDA tag #B37853310. Both the above were in observed in cooler #7 and retained at 0614 hours. 3. In cooler #2, I observed two skids of boxed product without labels. There were approximately 50-60 boxes involved. I tagged the product with USDA tag #B37853325. The product was tagged at 0617 hours. I immediately informed Ms. (QA) of the noncompliances. At 0650 hours, after the issue was resolved, I released the product. The issue of labeling all product was discussed in the weekly USDA/Plant meeting on 06/16/2010.This is a violation of 9CFR 381.116.
381.116(a) Each label for use on immediate containers for inspected and passed poultry products shall bear on the principal display panel (except as otherwise permitted in the regulations), the items of information required by this subpart. Such items of information shall be in distinctly legible form. Except as provided in § 381.128, all words, statements and other information required by or under authority of the Act to appear on the label or labeling shall appear thereon in the English language: Provided, however, That in the case of products distributed solely in Puerto Rico, Spanish may be substituted for English for all printed matter except the USDA inspection legend.
