FACTS RE USDA CONTRACT IN MAMK
March 29, 2013

We are all very happy that Mamaroneck Trustee Ilisa Miller made a motion to cancel the Mamk contract with the USDA; this motion was subsequently seconded by Trustee Andres Bermudez Hallstrom.  However It appears there is still some 'back-door' machinations going on here, and further contact to the mayor and Board of Trustees is requested forthwith.  
 
These are the facts as they stand regarding the USDA contract in Mamaroneck:
 
The contract with the USDA is effective on March 1, 2013 and expires on September 30, 2013.  The agreement �may be amended at any time by mutual agreement of the parties in writing.  Also, this Agreement may be terminated at any time by mutual agreement of the parties in writing, or by one party provided that the party notifies the other in writing at least 120 days prior to effecting such action.  Further, in the event the Cooperator does not provide necessary funds, APHIS WS is relieved of the obligation to provide services under this agreement.�

Since the services/killing of the geese will occur during time the geese molt and can�t fly, which is from June through late July, the Village has the required time to cancel the contract if it is cancelled immediately as no date for effecting the kill has been set in the contract. If we wait until the USDA shows up on Monday, April 1, to present what it already has in writing, this might open the village to liability if they do not use the other two remaining remedies. Sending an e-mail today could do the trick.
 
We are hearing the contract could have been voted on at the time the motion was made. Please tell all parties below to cancel the contract immediately: This contract can be re-established at a later date if the mayor and board so desire.
