Legal Action Network for Animals ("LANA") has served a Notice of Dangerous Condition on the Village of Irvington regarding its bow hunting of deer. It states in part:

The Legal Action Network for Animals1 (“LANA”) has been made aware of a potentially dangerous condition that not only poses a danger to humans, but goes against public opinion.
THE VILLAGE OF IRVINGTON is about to permit, or is currently permitting, a BOW AND/OR FIREARM HUNTING event, targeting (including but not limited to) deer, within the municipality. This may cause serious injuries to the general public as a result of “accidental” impaling, goring, shooting, or death to humans, along with emotional and psychological distress to the public and others who are traumatized by such violence, and additional risks exist including but not limited to the possibility of motor vehicle collisions with deer resulting from frightened or injured deer running into roadways.
LANA also believes, upon information and belief, that the permitting of this barbaric hunt/event goes against public policy, public opinion of the constituents in the subject area, and violates the basic tenet of treating animals and wildlife humanely. See:

LANA has further information to believe that the “contract” issued with respect to this “hunt” may not have been properly offered and/or vetted with respect to an RFP2, that said, please consider this an official FREEDOM OF INFORMATION REQUEST. In connection with the above matter, pursuant to the Freedom of Information Law Section 84-90, Public Officers Law, Article 6, kindly provide the following information to the undersigned:

any and all documents, communications, RFPs, bids, responses to RFPs, communications, memos, emails, deliberations, decisions, and any other information, records, and/or documentation, including but not limited to digital and/or written, in connection with the contract between the Village of Irvington and Kelley Deer Management, and any other companies retained and/or considered by the Village of Irvington, or who submitted proposals, with respect to deer “management”, including but not limited to hunting or other forms of “control”, inhumane or otherwise, and/or killing.
Pursuant to §89(3)(a) of the Freedom of Information Law, you have five business days to grant or deny access in whole or in part, or if more time is needed, to acknowledge the receipt of the request in writing and indicate an approximate date by which the agency will respond to the request, but not more than 20 additional business days. Thank you.
PLEASE TAKE FURTHER NOTICE that, in the event a Notice of Claim or other legal proceedings is filed against the Village of Irvington, in connection with any injury or death resulting from the subject bow and/or firearm hunting, the within shall become part of the public record in that proceeding, and same shall be considered prior written notice, and to satisfy the state’s “prior written notice” requirement, and the Village of Irvington shall be held fully accountable for any and all damages resulting therefrom.
